1. Agreement to Terms
These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Kreasi Kita ("we", "us", or "our"), concerning your access to and use of our services. By accessing our services, you agree that you have read, understood, and agreed to be bound by all of these Terms of Service.
2. Intellectual Property Rights
Unless otherwise indicated, the Site and our services are our proprietary property. However, upon full payment for a custom project (Website, App, or Design), the ownership of the final source code and assets is transferred to the client. We reserve the right to display the work in our portfolio unless a Non-Disclosure Agreement (NDA) is signed.
3. User Representations
By using our services, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you have the legal capacity and you agree to comply with these Terms of Service.
4. Payment and Revisions
We operate transparently regarding costs.
- A deposit is required to commence work.
- Final payment is due upon project completion and before final file delivery.
- We provide a specific number of revisions as outlined in our project proposal. Additional revisions may incur extra costs.
5. Limitation of Liability
In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the site or our services.
6. Governing Law
These Terms shall be governed by and defined following the laws of Indonesia. Kreasi Kita and yourself irrevocably consent that the courts of Indonesia shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
